1. Introduction

These Terms of Service ("Terms") govern your use of the Plektrify service ("Service") operated by Individual Entrepreneur Giorgi Kutelia ("Company", "we", "our", "us").

2. Acceptance of Terms

By accessing or using Plektrify, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

3. Description of Service

Plektrify is a GEO/AEO optimization platform that injects structured data (JSON-LD schemas) and meta tags into websites. The Service is provided "as is" and "as available."

4. Nature of the Service

Plektrify is a technical tool designed to inject Schema.org structured data (JSON-LD) and meta tags into websites based on user-defined configuration. The Service provides:

• A dashboard for configuring business information (Facts) and page rules
• A script that injects structured data according to your configuration
• CDN-based delivery of configuration data

The accuracy and appropriateness of the structured data depends on the information you provide. You are responsible for ensuring that the Facts and Rules you configure are correct and accurately represent your business.

Search engine rankings, AI citations, and visibility in any third-party platforms are determined by those platforms according to their own algorithms and policies. Plektrify provides technical infrastructure and does not control or influence how third parties process or display your content. Results vary based on numerous factors including but not limited to content quality, domain authority, competition, and platform-specific algorithms.

The Service is provided on an "as is" and "as available" basis. We strive to maintain service quality and reliability, but make no representations or warranties regarding specific outcomes from using the Service.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purposes
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service to distribute malware or harmful code
• Resell or redistribute the Service without authorization
• Violate any applicable laws or regulations

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by the Company and is protected by international copyright, trademark, and other intellectual property laws.

8. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. We reserve the right to change our prices with 30 days prior notice. Prices are displayed in US Dollars (USD).

All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. Paddle handles payment processing, invoicing, sales tax, and compliance on our behalf.

9. Refund and Cancellation Policy

Consumer Cancellation Rights (14 Days)

If you are a consumer, you have the right to cancel your subscription within 14 days from the day after completion of the initial transaction without giving any reason. To exercise this right, you must inform us of your decision before the 14-day period expires.

Important: This cancellation right applies only to the initial subscription purchase and does not apply to automatic renewals. For digital content that you have already started to use, the cancellation right may not apply.

Refund Requests

We offer refunds on a case-by-case basis. If you are not satisfied with the Service, you may request a refund by contacting us.

To request a refund:

• Contact us at [email protected] with your account email, order number, and reason for the refund request
• Refund requests are processed within 14 days of receiving your request
• Refunds will be issued to the original payment method with no additional fees

Subscription Cancellation

You may cancel your subscription at any time through your dashboard settings or by contacting us at least 48 hours before the end of the current billing period. Cancellation will take effect at the next payment date, and you will retain access until then.

Paddle as Merchant of Record

All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record. Paddle may process refunds in accordance with their Checkout Buyer Terms and Invoiced Consumer Terms.

Refund requests may be refused if there is evidence of fraud, refund abuse, or other manipulative behavior. This does not affect your statutory rights as a consumer in relation to products that are not as described, faulty, or not fit for purpose.

Note: Some payment methods have time limits for refunds (e.g., card payments within 120 days, PayPal within 179 days from the original transaction date).

10. Free Trial

We may offer a free trial period for certain plans. At the end of the trial period, you will be required to select a paid plan to continue using premium features. No payment information is required during the trial.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time with reasonable notice. We are not liable for any downtime or service interruptions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may terminate your account at any time through the dashboard settings. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Tbilisi, Georgia.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service at least 30 days before the changes take effect.
